Residency Obligations, Physical Presence & Exemptions
While CIES is often perceived as a flexible residency-by-investment program, it does carry expectations related to physical presence—particularly for those seeking to eventually qualify for permanent residence status.
Applicants must reside in Hong Kong on the basis of their entrant visa, which is typically issued for an initial period of two years, followed by a three-year extension, and then additional extensions upon continued compliance. During each period, they must maintain their qualifying investment and remain in good standing with the Immigration Department.
Although there is no explicit minimum physical presence requirement written into the scheme for basic renewal, applicants are advised to maintain a meaningful connection to Hong Kong—ideally by spending at least 90 days per year in the territory. This is especially important for those who eventually wish to apply for permanent residency (Right of Abode), which requires seven years of continuous ordinary residence.
There are no formal exemptions available from these residency expectations. However, certain time spent abroad may be accepted if justified by business obligations, family responsibilities, or force majeure events—provided the applicant maintains a Hong Kong home and demonstrates substantive ties.
